By accessing or purchasing from this site ("Site"), you agree to be bound by the following Terms of Service and Sale ("Terms"). These Terms govern your use of our website, products, and services. Please read carefully.

1. General Overview This website is operated by Elightcare LLC, the official representative of Callegari USA. Throughout the Terms, "we," "us," and "our" refer to Elightcare LLC. We provide this website, e-commerce platform, and all services conditional upon your acceptance of these Terms.

By accessing this site or placing an order, you agree to these Terms, including the policies linked herein (e.g., Refund Policy, Warranty Policy, Privacy Policy).

We reserve the right to update or modify these Terms at any time by posting changes to this page. Continued use constitutes acceptance of those changes.

2. Age and Authorization You must be at least the age of majority in your jurisdiction or have consent from a legal guardian. Purchases made on behalf of a business or clinic must be authorized by an individual with legal signing authority.
3. Product Use and Classification Callegari products, including Soft FX and related systems, are intended for cosmetic/aesthetic use only. They are not medical devices and are not intended to diagnose, treat, or prevent any medical condition. Any clinical or treatment use is at the discretion and risk of the purchaser.
4. Order Acceptance & Refusal We reserve the right to refuse any order. We may limit or cancel quantities per customer, household, clinic, or sales channel. If your order is modified or declined, we will attempt to notify you using the contact details provided at checkout.
5. Payment Terms All payments must be made in U.S. Dollars. We accept bank transfer, certified check, and approved card payments. Full payment is due prior to delivery unless otherwise agreed in writing.

If using a payment plan, you agree to the Payment Agreement (Exhibit A). Late payments may incur interest and administrative fees. Failure to pay may result in legal action and repossession of equipment.

6. Delivery Delivery timelines are estimates. Title transfers upon full payment. Risk of loss transfers upon delivery. Delays caused by force majeure events do not constitute breach.
7. Return & Refund Policy Returns must be pre-authorized in writing. You have 14 days from delivery to request a return if the item is unused and in original packaging.

  • A 25% restocking fee applies to authorized returns.

  • Shipping, installation, training, and other service costs are non-refundable.

  • Promotional items must be returned with the main unit, or their value will be deducted from the refund.

  • No refunds are given for custom/pre-order items or services rendered.

Equipment is not offered on a trial or evaluation basis. By completing the purchase, the buyer acknowledges responsibility for use, selection, and integration of the product into their operations.

8. Warranty

  • Main console: 2-year limited warranty

  • Accessories and probes: 1-year limited warranty

  • Warranty starts on the first use or no later than 7 days after delivery.

Warranty excludes misuse, unauthorized modifications, wear-and-tear, improper voltage, and inadequate packaging during returns. Customer is responsible for return shipping for warranty claims.

9. Limitation of Liability In no event shall Elightcare LLC or Callegari USA be liable for indirect, incidental, or consequential damages, including lost revenue or business disruption. Total liability shall not exceed the purchase price paid.

Elightcare LLC makes no representations or warranties regarding specific treatment outcomes, client results, or commercial success derived from the use of its equipment. Purchaser assumes full responsibility for clinical, operational, or business use.

10. Intellectual Property All content, trademarks, and materials on the website are the property of Elightcare LLC or its affiliates. No unauthorized use is permitted.
11. Governing Law and Dispute Resolution These Terms shall be governed by the laws of the State of California. Any dispute shall be resolved exclusively in the state or federal courts of Orange County, California. You waive the right to trial by jury.
12. Data Protection Your submission of personal data is governed by our Privacy Policy [link]. We comply with all applicable data protection laws.
13. Force Majeure We are not liable for delays or failures caused by events beyond our control, including natural disasters, supply chain disruption, or regulatory changes.

15. Indemnification The buyer agrees to indemnify, defend, and hold harmless Elightcare LLC, its officers, directors, agents, employees, and affiliates from any claims, liabilities, damages, or expenses arising from misuse of products, breach of these Terms, violation of applicable laws, or third-party claims related to buyer’s use or marketing of the products.
16. Confidentiality All pricing, quotations, and related sales documentation are confidential and intended solely for the recipient. Reproduction or sharing with third parties without written permission from Elightcare LLC is strictly prohibited.
17. Assignment The customer may not assign, delegate, or transfer any rights or obligations under these Terms without written consent from Elightcare LLC. Any attempted assignment without authorization is void.
